The Ministry of Justice issued Circular No 23/2010/TT-BTP on December 6, guiding implementation of Government Decree No 17/2010/ND-CP of March 2010 on property auctions.
Under the circular, the Judicial Academy of the Ministry of Justice will train professional auctioneers and be responsible for probation of trainees placed with professional auction organisations. Trainees with bachelor's degrees in law would see the duration of training shortened by a third.
The circular includes detailed provisions on registering auctioneers, including procedures for adjusting an auctioneer's affiliation with a particular organisation, the issuances and replacement of auctioneer's cards, the withdrawal of practical certificates, and other provisions relating to property auctions, as well as sample forms.
The circular also allows auction organisation to establish branches within and outside provinces or cities in which the organisation is headquartered.
Circular No 23 takes effect on January 24 and replaces Circular No 03/2005/TT-BTP of May 2005, which was promulgated under a previous Government decree on asset auctions from January 2005.
Secured transactions online
The Ministry of Justice issued Circular No 22/2010/TT-BTP on December 6, providing guidelines on online registration of secured transactions. Under the circular, which takes effect next March 1, individuals or organisations that frequently register or search registrations of secured transactions or contracts may apply for a regular client code and an online account. Others will be able to sign onto the Online Registration Database via a payment voucher number.
Rules for project consultants
Circular No 23/2010/TT-BKH was promulgated by the Ministry of Planning and Investment on December 13, specifying professional requirements for investment project assessment consultants.
Circular 23 requires that only individual consultants or staff employed by corporate consultants with professional certification in the same field granted by a duly-licensed training agency in Viet Nam or overseas is permitted to participate in providing assessment consultancy on an investment project.
The circular also establishes first- and second-level professional certifications based on experience. Corporate consultants are classified based on qualification and experience of staff, as well as size, financial capacity, and equipment and facilities owned or leased.
